The article is devoted to analyzing the philosophical interconnections between “language and power”, power discourse and power relations realized through language. Power relations are often reduced to the political sphere, thus excluding the manifestation of power in other institutional discourses, such as a penitentiary discourse. The term “discourse” has entered the research vocabulary of philosophy, sociology, political science, anthropology and its interpretation varies depending on the positions taken by scholars. The importance of the study is based on the fact that the correlation between language and power in penitentiary discourse is not sufficiently studied. Moreover, it is important to examine the philosophical aspect of the correlation between the realization of the language of power and the deprivation of access to discourse among individuals devoid of any power. The scientific novelty of the article consists in the investigation of a significant problem of the discursive linguistics. The novelty of the knowledge obtained is based on the examination of the philosophical aspect of the most important social problem — inequality of access to discursive practices of one sector of the society, for example, in the penitentiary discourse. The main research method used is the critical discourse analysis method in the interpretation of M. Foucault, T. A. van Dijk, N. Fairclough, R. Fowler and other researchers. The theoretical significance of the study lies in the definition of power discourse as a discourse that establishes hierarchical institutional relations through utterances or other communicative acts. Power discourse exhibits also resistance to power. The main result of the research is the fact that the speech act can be interpreted as a common tool for the realization of the interests of the both groups: power and resistance to power. The essential difference between the participants of power relations lies in their unequal access to discourse.
